In students’ circles, it is a very popular topic. How to switch to Tier 1 Exceptional Talent Visa from student Tier 4 General visa? In my previous post, I wrote about a purely legal and classical situation. But today I will share with you insight that I got from one of the real applicants who has this situation.

On the Home Office website, there is a brief list of three visas categories. This is a full list for people allowed to switch. In other words, they explain, when people can to apply for Tier 1 Exceptional Talent Visa when living in the UK.

Tier 4 General visa is not on that list. This means that if you are a student, you are not lucky one. And you cannot switch from your visa to Global Talent.

However, I got an interesting insight. An applicant with a Tier 4 General visa told me about a gap. Or a small window of opportunity for people who have a visa in this category. Please, read the information below very carefully and remember my Disclaimer, I mean – I am not sharing any immigration legal advice here.

Switch to Tier 1 Exceptional Talent Visa from Tier 4 General: Stage 1

Submission: (if you are brave enough – in the UK) outside the UK.

And here is the hidden gem: you may try your luck and apply for Endorsement Stage of Tier 1 Exceptional Talent Visa even from the United Kindom. In other words, even living in the country you may apply all documents, pay the fee and wait for a Tech Nation decision.

This option is so flexible since for an Endorsement stage you will be checked only for your professional abilities and talents. That is why, is it quite a narrow way, but knowing how it is difficult to be a student and fly home to apply for the first stage of visa, this opportunity makes your life slightly easier.

Switch to Tier 1 Exceptional Talent Visa from Tier 4 General: Stage 2

Submission: only outside the UK

This is an important moment. If you get your Endorsement, you must fly to your home country. Do it as soon as possible to apply for Stage 2. It is not allowed to stay in the country and apply. So, please, do not try to do this.

The reason for the situation mentioned above is clear. Basically, you must apply for Tier 1 Exceptional Talent Visa from outside the UK. Hence, in the case of non-Endorsement, the UK immigration system will not be under the risk that one more illegal immigrant will join the army of people who live in the UK on an illegal basis.

Your circumstances could be so unique that you may apply for this visa from inside the UK. Even if you are a student on the Tier 4 General visa. For example, Coronavirus outbreak brought significant changes.

  1. The situation in my country regards Covid-19 is uncertain. I have sent my endorsement application already and wondering if I can go to any nearby country and apply from there. My tier 4 visa expires in January of 2021.

      Thanks for your comment. I hope I understand your situation correctly.
      There is no limitations for a person on the UK Tier 4 Visa to apply from any country but not the UK. So you can find the country, which will be the best fit for your budget and location, and apply from there.
